By renting and/or using paddleboards, paddles, life jackets, or related recreational equipment (“Equipment”) provided by Pedal and Plate LLC (“Pedal and Plate”), I acknowledge and agree to the following terms and conditions.
I accept full responsibility for the safe use, care, and return of the Equipment during the rental period. I authorize Pedal and Plate to charge the payment method on file for any loss, theft, excessive damage, or replacement costs caused while the Equipment is in my possession, excluding normal wear and tear.
If any Equipment is lost, stolen, damaged beyond repair, or not returned, I understand I may be responsible for the full replacement value.
I understand that this Agreement applies to myself and any additional participant using the rented Equipment under my reservation.
If Pedal and Plate, at its sole discretion, determines that the paddleboard must be replaced due to loss, damage, theft, or vandalism, I authorize Pedal and Plate to charge my credit card on file Five Hundred Dollars ($500) and agree that is a reasonable replacement fee.
RENTAL TERMS & PARTICIPANT RESPONSIBILITIES
All Equipment must be returned by the agreed return time in substantially the same condition as when rented.
Equipment may only be used during the approved rental period.
Participants must obey all federal, state, and local laws, waterway regulations, and safety rules.
Life jackets are required and should be worn at all times while using the Equipment.
Participants may not use the Equipment while under the influence of alcohol, drugs, or any substance that impairs
judgment or coordination.
Participants must inspect the Equipment before use and immediately report any damage or safety concerns.
Equipment may only be used in safe weather and water conditions. Use during storms, high winds, rough surf, or
lightning is prohibited.
Participants are responsible for safely securing all personal belongings while using the Equipment.
Participants agree not to exceed the Equipment’s recommended weight limit.
Children under the age of eighteen (18) must be supervised by a parent or legal guardian.
Participants understand that paddleboarding requires balance, coordination, and physical activity and may result in falls or injury.
Participants are responsible for any damage, injury, fines, or claims resulting from their use or misuse of the Equipment.
All Equipment is provided “AS IS” without warranties of any kind, either expressed or implied.
ASSUMPTION OF RISK & LIABILITY RELEASE
I understand that paddleboarding and water activities involve inherent risks, including but not limited to drowning, falls, collisions, changing water conditions, weather conditions, equipment failure, marine life encounters, and physical injury.
I voluntarily choose to participate in these activities and knowingly assume all risks associated with the use, transportation, and operation of the Equipment.
To the fullest extent permitted by law, I release and hold harmless Pedal and Plate LLC, its owners, employees, affiliates, contractors, and representatives from any and all claims, liabilities, injuries, damages, losses, or expenses arising from or related to the rental or use of the Equipment.
I further agree to indemnify and defend Pedal and Plate against any claims, demands, damages, legal actions, or expenses resulting from my use or misuse of the Equipment, except in cases of gross negligence or intentional misconduct by Pedal and Plate.
I acknowledge that I am responsible for maintaining adequate insurance coverage for myself and any additional participants under this Agreement.
GOVERNING LAW
This Agreement shall be governed by and interpreted under the laws of the State of Florida.
ACKNOWLEDGEMENT & SIGNATURE
I have carefully read and understand this Agreement.
I voluntarily accept these terms and conditions.
I understand this document includes a release of liability and assumption of risk.
I agree to comply with all rental and safety requirements.
I consent to the use of my electronic or written signature for this Agreement.
