By renting and/or operating the electric bicycles or related recreational equipment (“Equipment”) provided by Pedal and Plate, LLC (“Pedal and Plate”), I acknowledge and agree to the following terms and conditions.
I accept the Equipment in its current condition and understand that I am responsible for its care and proper use during the rental period. I authorize Pedal and Plate to charge the payment method on file for any loss, theft, excessive damage, vandalism, or replacement costs resulting from misuse or failure to follow this Agreement, excluding normal wear and tear. If an electric bicycle is determined by Pedal and Plate to be damaged beyond repair, stolen, or otherwise unusable due to negligence, misuse, theft, or vandalism while in my possession, I understand I may be charged up to the full replacement value of the Equipment. I understand that this Agreement applies to myself and any additional rider listed under my reservation or using the rented Equipment with my permission. I agree to ensure all users understand and comply with these terms.
If Pedal and Plate, at its sole discretion, determines that the electric bicycle must be replaced due to loss, damage, theft, or vandalism, I authorize Pedal and Plate to charge my credit card on file One Thousand Two Hundred Dollars ($1,200) and agree that is a reasonable replacement fee.
RENTAL TERMS & RIDER RESPONSIBILITIES
All Equipment must be returned on or before the agreed return date and in substantially the same condition as when rented, excluding ordinary wear and tear.
Equipment may only be used during the approved rental period.
Riders must obey all federal, state, and local laws, traffic regulations, and community guidelines while operating the Equipment.
Equipment is intended for paved roads and approved riding areas only.
Riders may not operate Equipment through standing water, heavy rain, or unsafe weather conditions.
Only authorized riders listed on the rental agreement may operate the Equipment.
Riders must be at least twenty-one (21) years of age unless otherwise approved by Pedal and Plate.
Equipment may not be operated while under the influence of alcohol, drugs, or any substance that impairs safe operation.
Helmets are strongly recommended and should be worn while riding. Riders who choose not to wear a helmet accept all associated risks.
Riders may not alter, modify, or attach unauthorized accessories to the Equipment.
No passengers are permitted unless the bicycle is specifically designed and approved for multiple riders.
Riders agree not to exceed the Equipment’s stated weight limit.
Riders confirm they understand the proper use and operation of the Equipment, including acceleration, braking, charging, and battery operation.
Any accident, malfunction, damage, or theft involving the Equipment must be reported to Pedal and Plate immediately.
Riders are responsible for properly securing the Equipment using locks or security devices provided by Pedal and Plate.
Riders accept responsibility for any injury, property damage, fines, citations, or claims resulting from their use or operation of the Equipment.
All Equipment is provided “AS IS” without warranties of any kind, either expressed or implied.
ASSUMPTION OF RISK & LIABILITY RELEASE
I understand that operating electric bicycles and recreational equipment involves inherent risks, including but not limited to falls, collisions, equipment failure, road hazards, weather conditions, and actions of other riders, drivers, or pedestrians. These risks may result in serious injury, disability, death, or property damage.
I voluntarily choose to participate in these activities and knowingly assume all risks associated with the use, transportation, and operation of the Equipment.
To the fullest extent permitted by law, I release and hold harmless Pedal and Plate LLC, its owners, employees, affiliates, contractors, and representatives from any and all claims, liabilities, damages, injuries, losses, or expenses arising from or related to the rental or use of the Equipment, including claims based on negligence.
I further agree to indemnify and defend Pedal and Plate against any claims, demands, damages, legal actions, or expenses resulting from my use or misuse of the Equipment, except in cases of gross negligence or intentional misconduct by Pedal N Plate.
I acknowledge that I am responsible for maintaining adequate insurance coverage for myself and any additional riders participating under this Agreement.
GOVERNING LAW
This Agreement shall be governed by and interpreted under the laws of the State of Florida.
ACKNOWLEDGEMENT & SIGNATURE
I have carefully read and understand this Agreement.
I voluntarily accept these terms and conditions.
I understand this document includes a release of liability and assumption of risk.
I agree to comply with all rental rules and safety requirements.
I consent to the use of my electronic or written signature for this Agreement.
